These Terms of Service ("Terms") are a legally binding agreement between you ("you," "Customer," or "User") and DataMCP LLC ("DataMCP," "we," "us," or "our"), a Wyoming limited liability company with its principal address at 30 N Gould St Ste R, Sheridan, WY 82801, United States.
By accessing or using the Jobs Tomato website, application, APIs, and related services (collectively, the "Service"), including at thirdpartyhouse.com and associated domains, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and legally able to enter into contracts. You may register with email and password, magic-link sign-in, or supported OAuth providers (e.g., Google) when enabled.
You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at support@jobstoma.to if you suspect unauthorized access.
You represent that information in your profile and CV is accurate to the best of your knowledge. The Service tailors and presents your real experience - it does not authorize fabrication of qualifications, employment, or credentials.
Jobs Tomato offers paid monthly subscriptions (pricing shown on /pricing at time of purchase). As of the last update above, plans include:
We may change pricing or plan features with at least 30 days' notice before the change applies to your next renewal. Changes do not affect the current paid billing period.
Paid subscriptions are processed by Stripe. By subscribing, you authorize recurring monthly charges to your payment method until you cancel. Subscriptions renew automatically unless cancelled before the renewal date.
You may cancel at any time through account settings or by contacting support. Cancellation takes effect at the end of the current billing period. See our Refund Policy for refund rules.
Taxes may apply based on your location. You are responsible for applicable taxes unless Stripe collects them on our behalf.

You are solely responsible for compliance with each employer's and job board's application rules. The Service assists your workflow; it does not guarantee that a third party will accept your application.
Accuracy. You provide your master CV and career facts. Our AI rewrites and formats content for specific roles within the constraints of your data and product rules. You must review generated materials before submitting them where the product requires confirmation.
No training on your CV. We do not use your documents to train public foundation models. Content is processed through third-party AI APIs solely to deliver the Service to you, as described in our Privacy Policy.
Agent & screening data. You configure how the agent answers application questions (work authorization, availability, compensation policies, etc.). Required fields without a confident answer may block automated submission until you provide input.
No outcome guarantee. Jobs Tomato improves speed and quality of applications. We do not guarantee interviews, offers, or salary outcomes.
You retain ownership of your Customer Data. We process it only to provide and improve the Service, as described in our Privacy Policy and Data Processing Addendum. You grant us a limited license to host, process, and transmit Customer Data as necessary to operate the Service.
We own the Service, software, design, documentation, and Jobs Tomato branding. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service according to your plan. You may not use our trademarks without written permission.
You own tailored PDFs and documents generated for you from your own content, subject to third-party rights in templates or fonts we license.
The Service is provided on an "as available" basis. We may modify, suspend, or discontinue features with commercially reasonable notice when practicable. Scheduled maintenance may occur without liability for brief interruptions.
The Service relies on third parties including Stripe (payments), cloud hosting, databases, object storage, email delivery, and AI providers. Your use may be subject to their terms. We are not responsible for third-party websites, job boards, or employer systems.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATAMCP LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST OPPORTUNITIES, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO DATAMCP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS ($100) IF YOU HAVE NOT PAID FEES, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.
You agree to indemnify and hold harmless DataMCP LLC and its officers, members, employees, and agents from claims arising out of: (a) your use of the Service; (b) your Customer Data; (c) your violation of these Terms or applicable law; or (d) applications you submit to employers.
You may close your account at any time. We may suspend or terminate access for violation of these Terms, non-payment, fraud, or risk to the Service or other users. Upon termination, your right to use the Service ends. We may retain data as described in the Privacy Policy and as required by law.
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Disputes shall be brought in state or federal courts located in Wyoming, except where prohibited by consumer protection law in your country of residence.
Before formal proceedings, contact support@jobstoma.to to seek informal resolution.
We may update these Terms. Material changes will be notified by email or in-product notice at least 30 days before they take effect. Continued use after the effective date constitutes acceptance. If you disagree, cancel before renewal and stop using the Service.
